Gillam & Wife & Others  to  Thomas Rhodes            9 Feb 1814          Bertie Co, North Carolina

 

            This Indenture made this ninth day of February in the year of our Lord, One Thousand eight hundred fourteen, between MOSES and WINNIE GILLAM, JAMES and SARAH RUTLAND of Bertie County and State of North Carolina and WILLIAM and NANCY JOSEY of the County of Northampton and State aforesaid of the one part, and THOMAS RHODES of the County of Bertie and the State aforesaid of the other part, Witnesseth  that the said MOSES and WINNIE GILLAM, JAMES and SARAH RUTLAND and WILLIAM JOSEY and NANCY his wife for and in consideration of the sum of Three Hundred and Seventy Five Dollars, to them in hand paid by the said THOMAS RHODES the receipt whereof we do hereby acknowledge, have granted bargained sold aliened release enforce and confirmed, and do by these presents absolutely grant bargain sell alien enforce and confirm unto the THOMAS RHODES his heirs and assigns forever each and singular their part of the land which fell to them by the death of RHOMAS RHODES, deceased of Bertie County and State of North Carolina, containing One Hundred and Nine acres more or less situate lying and being in the County of Bertie and State of North Carolina with all and singular the Orchards privileges and appurtenances thereunto belonging or in anywise appertaining. To have and to hold the said land and assigns forever in as true and absolute a manner to all intents and purposes as they the MOSES and WINNEY GILLAN, JAMES and SARAH RUTLAND and WILLIAM and NANCY JOSEY now held or ever did hold the said land and premises and in such right in fee simple absolutely release from all in cumbrances whatever and the said MOSES and WINNIE GILLAM, JAMES and SARAH RUTLAND and WILLIAM and NANCY JOSEY bind themselves, their heirs and Executors and Administrators forever to warrant defend the said Land and premises from the claim of any person or persons whatever to the said THOMAS RHODES his heirs and assigns forever.

            In witness whereof we the said MOSES and WINNEY GILLAM, JAMES and SARAH RUTLAND and WILLIAM and NANCY JOSEY have hereunto set our hand and Seals the day and year above written.

            The private examination of WINNIE GILLAM, SALLEY RUTLAND and NANCY JOSEY was this day taken by me under a deputation from the Court touching their free consent as to the sale of the land mentioned in the within Deed of Sale, Each of whom sayeth that they have agreed to the sale, and have assigned the same of their own free will and accord, and without any kind of fear or compulsion of their respective husbands, Given under my hand this 14th day of February 1814.   JOSEPH JORDAN  J.P.

Bertie County Court.    This Deed from MOSES GILLAM & others to THOMAS RHODES was proved in open court by the oath of MOSES BISHOP one of the subscribing witnesses there to.  The private Examination of WINNIE GILLAM, SALLEY RUTLAND & NANCY JOSEY having been taken, thereon indorsed by JOSEPH JORDAN, Esquire, one of the members of the court under a deputation therefore it is ordered that the Deed & Examination be registered.
