29 June 1870                           MARTHA JOSEY,  Will

 

     In the name of God, Amen!  I, MARTHA JOSEY being of sound mind and disposing memory, do make, ordain, publish, and declare this to be my Last Will and Testament in the manner and form following, to Wit; 

      ITEM 1st; I commit my soul unto God who gave it, and desire that my body shall have a decent burial, I desire to be buried in a metallic coffin by the side of my deceased Son WILLIAM T. JOSEY; and that my executor hereafter named shall cause to be erected over my grave a suitable tombstone, The cost of which is hereby left to his discretion, and that my said executor shall also cause to be erected over the grave of my deceased Son WILLIAM T. JOSEY a suitable tombstone, the cost of which is hereby left to his discretion.

      ITEM 2;  I give and devise to MARTHA INDIANA WILLIAMS, Wife of WILLIAM R.T. WILLIAMS, a piece or parcel of land, containing Two Hundred acres (200), more or less, adjoining the land commonly known as the" RANDOLPH Tract of Land" and lands of JAMES T.LAMBERTON and Others, to have and to hold the said piece or parcel of land unto the said MARTHA INDIANA WILLIAMS, during her life, free and clear from all indebtedness of her said Husband, now and hereafter to be controlled, remainder after her death, to her Children now born, or hereafter to be born, and her heirs forever, equally be divided among them. 

     ITEM 3; I reserve One acre of land in and around the Graveyard, and devote it to the purpose of a family Graveyard; and I devise it to my executor and his heirs forever for said trust and purpose.

     ITEM 4; I desire my executor to have said Graveyard suitable enclosed at the expense of my Estate.

     ITEM 5: All the balance of my land I give and devise to my dear SALLIE A. NORWOOD, to have and to hold the same, to her and her heirs forever.

     ITEM 6;  I give to MARTHA INDIANA WILLIAMS, my center table and my two large China Pitchers.

     ITEM 7; I give and bequeath to the said SALLIE A. NORWOOD, Two Beds and Bedsteads, and Furniture for both, to be chosen and selected by her, I also give to the said SALLIE A. NORWOOD, the Washbowl and Pitcher that belong to her room, also the Set of Parlor Chairs, also the Sofa that is in the parlor,  also the parlor Window Curtains and Carpet, and Sideboard.

     ITEM 7; I give and bequeath to MARTHA BRINKLEY, Wife of S.P. BRINKLEY, my Mahogany Table and the Bureau that is in my bedroom.

     ITEM 8; It is my will and desire that SALLIE A. NORWOOD, and MARTHA INDIANA WILLIAMS, shall divide among themselves all of my Trunks and Weaving apparel so as to suit themselves; and in like manner they shall divide among themselves my Bed quilts and Counterpains, leaving enough furniture for each bed and bedstead.

     ITEM 9; I desire my executor to collect, as soon as possible , all money that is due me by bond, note, due bill or account. It is my will and desire that my executor shall sell for cash, at public auction, after due notice, all the balance of my Estate of every kind and description. Out of the proceeds of the sale, and the money that may be found and have at my death, and the money that may be collected on my choices in action. my executor shall pay all of my just debts, and funeral expenses, and the costs and expenses of the Two Tombstones aforesaid, and the erecting of them, and the aforesaid enclosure around the Graveyard, and the balance, if any, shall be equally divided among the said SALLIE A. NORWOOD and MARTHA INDIANA WILLIAMS.

     ITEM 10;  In consideration of what I have here given, bequeathed and devised to SALLIE A. NORWOOD, I require that the said SALLIE A. NORWOOD shall cancel and surrender to my executor, a certain bond she holds against me dated the 9th day of September 1862, and payable, one day after date, in the sum of Eight Hundred and Twenty Dollars, and upon her failure to do so, she is to forfeit all that I have here given, bequeathed and devised to her.

     ITEM 11;  I nominate and appoint my friend W.W. PEEBLES, as executor to this, my Last Will and Testament. And I do hereby revoke and cancel all former Wills and Testaments, by me heretofore made.

     Signed, Sealed, Published, and Declared to be my Last Will and Testament.  This the 29th day of June A.D. 1870. in the presence of.
