& Others to JAMES JOSEY Jr.
This Indenture made the 14 th day
of August in the year of our Lord Christ 1769, Between JOHN WHITAKER SR. and
OLIVE his wife and EDWARD WHITAKER and SARAH his wife of Halifax
County in the Province of North Carolina
of the one part and JAMES JOSEY, of the County and Province aforesaid of the
other part. Witnesseth that the said JOHN, OLIVE, EDWARD and SARAH for and in
consideration of the sum of Two Hundred pounds proc. money, to them in hand
before the ensealing and delivery hereof will and
truly paid by JAMES JOSEY JR; the receipt whereof the said JOHN, OLIVE, EDWARD
& SARAH, doth hereby acknowledge and themselves therewith fully satisfied,
and paid, and of every part and parcel thereof doth hereby acquit and discharge
the said JAMES JOSEY, and his heirs for ever hath granted, bargained, sold,
conveyed, and confirmed, and by these presents doth fully freely clearly and
absolutely grant, bargain, sell, convey, and confirm, to him the said JAMES
JOSEY, his heirs and assigns forever, a Plantation and tract or parcel of Land
containing by estimation, Two Hundred and Forty One acres be the same more or
less lying on the South side of Looking Glass Swamp, in the County aforesaid.
Beginning at a Cypress in the said swamp, running South 200 poles to a Live Oak
in PAUTTIERS pocoson, thence East 65 poles to a
" Gum" JOHN WHITAKER JR. corner, then along the dividing line of marked trees to the said Swamp at the head of
the Mill, Then continued the same course over the said Swamp to a corner
hickory in CHAMPION'S line, then along his line to a corner White Oak, thence
the run of the said Swamp to Three Cypresses, then up the meanders of the said
Swamp to the first station. All the reversion, and reversions, remainder, and
remainders, and all the whole right title and estate of the said JOHN, OLIVE,
EDWARD, and SARAH, into or out of the said land and premises. To have and to
hold forever the said granted, and bargained premises with all the
appurtenances and privileges thereunto belonging or in any way appertaining to
him the said JAMES JOSEY, his heirs assigns forever and the said JOHN, OLIVE,
EDWARD, and SARAH, for themselves, their heirs, executors, administrators, and
assigns, in the penal sum of One Thousand pounds good and lawful money of Great
Britain to indemnify the said JAMES JOSEY, his heirs, executors,
administrators, and assigns, against any person or persons whatsoever,
hereafter laying any right claim in demand unto the said land and premises
above mentioned, and doth likewise bind themselves, their heirs, executors,
administrators, and assigns in the aforesaid sum of One Thousand pounds good
and lawful money of Great Britain. That the said JAMES JOSEY, his heirs, and
assigns, shall and may at all times hereafter lawfully and peaceably enjoy the
aforesaid land and premises with all the appurtenances, free and clear from all
incumbrances whatsoever, and the said JOHN, OLIVE,
EDWARD, and SARAH, their heirs, assigns the said land with all the
appurtenances unto the said JAMES JOSEY, his heirs and assigns forever will
well and truly warrant and forever defend in witness whereof the said JOHN,
OLIVE, EDWARD, and SARAH, hath hereunto set their hands and seals, the day and
year above mentioned.
