6 February 1795.      Will of JAMES JOSEY

 

                In the name of God, Amen. I, JAMES JOSEY, of the County of Halifax and State of North Carolina being in a declining state of health, recollecting the instability of this transitory state of existence and desirous to prepare as much as in my power for that great change which is the common lot of humanity, do therefore make and ordain  my last Will and Testament as follows, (Viz)    I surrender my soul to it's creator, almighty God from whom it originally proceeded, and my body to be committed to it's conatural  dust.

     Item.-  I give and bequeath to my beloved Wife, LYDIA JOSEY my negro Man named DICK, my negro Boy named JACK, and a certain specialty for money due me of SAMUEL PITMAN, to her the said LYDIA JOSEY, and her heirs forever, and I recommend to my said Wife LYDIA, when she can make it convenient, to apply part of said money due of SAMUEL PITMAN, when she recovers it, in purchasing the Wife of said negro DICK, on condition that her owner will sell her at any reasonable price.

     Item.-  After my Just debts are paid, I give and bequeath all singular the residue and remainder of my Estate of every kind whatever to my beloved Wife, the aforesaid LYDIA JOSEY, to her heirs forever. Lastly, I constitute and appoint my esteemed friend and cousin, CARY WHITAKER, sole executor to this my Last Will and Testament. In witness whereof I have hereunto set my hand and affixed my seal the 6 th day of February in the year of our Lord, One Thousand Seven Hundred and Ninety Five.
