HALIFAX COUNTY NORTH CAROLINA DEED BOOK 29 PAGE 303 November Session 1835.

To the Worshipful, the Justices of the Court of Pleas & quarter Sessions for the County aforesaid. The petition of HENRY APPLEWHITE, THOMAN GODWIN & wife formerly ELIZABETH APPLEWHITE & of JOSEPHINE & NAPOLEON JOSSEY infants of HENRY JOSSEY and SARAH his wife formerly SARAH APPLEWHITE who petitioned by THOMAS GODWIN their aunt friend & Guardian in this behalf showeth unto your Worships that they are tenants in common in their several tracts of land lying in Halifax County adjoining the lands of JESSE POWELL, WILBER HIGGS, ROBERT WHITAKER & Others in the following proportions, to make your petitioner HENRY APPLEWHITE  is entitled  to One Third your petitioner THOMAS GODWIN & wife ELIZABETH to One Third, and your petitioners JOSEPHINE & NAPOLEON to One Sixth each. They pray your Worships that Commissioners be appointed to divide the lands aforesaid & allot to your petitioners their several shares & grant unto your petitioners such other witness which their case may require & as in duty bound they will ever Pray.

Ordered by the Court that JESSE POWELL, ROBERT WHITAKER, WILBER HIGGS, THOMAS B WHITEHEAD, T.T. BRANTLEY, any three to act be appointed Commissioners to divide the lands named in the foregoing petitioners & to allot to each petitioners the part prayed for. Report to next Court.

Pursuant to an Order of Court we the undersigned Commissioners have proceeded to divide the lands belonging to ELISHA APPLEWHTE dec’d as follows. Lot No 1, being the House tract in Pine Woods containing 76 acres drawn by NAPOLEON & JOSEPHINE JOSSEY and pays Lot No 2&3 Seven Dollars & eighty Three Cents each. Lot No 2 drawn by THOMAS GODWIN containing 30 acres being the House lot at Sandy Neck & pays Lot No 3 Thirty Dollars. Lot No 3 drawn by HENRY APPLEWHTE containing 20 acres __ from Lot No 2, Thirty Dollars. The following are the course & distance of the House tract in Pine Woods. Beginning at a large Pine, JESSE POWELL'S comer, then S 14 W 46 poles to a Small Pine, then S 71 E 91 poles to a Stake, then N 47 E 20 poles to a Pine, JOHN DAVIS corner, then N 3 W 58 poles to a Branch, then N 76 E 40 poles to the edge of the Creek, then up the said Creek 117 poles to a comer in Pocoson Branch, then S 3 E 60 poles to a Pine, then S 81 w 120 poles to the Three Pines, JESSE POWELL'S line and thence to the beginning. Lot No 2. Beginning at a Sassafras S 62 W 4 poles to a Stake, then S 43 E 113 poles to a Stake, then N 28 E 61 poles to a Comer Sourwood. then N 56 W 85 poles to the beginning. Lot No 3. Beginning at a Stake, then S 43 E 70 poles to the main run Spring Branch, thence up Spring Branch 69 poles to the mouth of the Branch, then N 42 W 54 poles to the Corner Sourwood, then S 28 W to the beginning.
