3 September 1750       ELIAS WILLIS   to  JAMES JOSSY (sic)

 

                This indenture made the Third day of September in the year of our Lord 1750, between ELIAS WILLIS of Northhampton County in the Province of North Carolina, Planter, of the one part and JAMES JOSSY, of the said County and Province, Cordwainer, of the second part, witnesseth that the said ELIAS WILLIS, for and in consideration of the sum of Eleven Pounds, current money of Virginia and to him in hand paid on or before the ensealing and delivery of these presents, the receipt whereof  the said ELIAS WILLIS, doth hereby acknowledge thereof, and of every part and parcel thereof, doth hereby acquit, and discharge him the said JAMES JOSSY, by these presents hath given, granted, bargained and sold and by these presents doth give, grant, bargain and sell unto him the said JAMES JOSSY, his heirs and assigns, one part or parcel of land situated as followeth, that is on the Easterly side of Bridgers Creek, beginning at a line in EMANUEL ROGERS ?, upper corner on the said Creek, thence up the water course of the said Creek to GEORGE STEVENSON'S corner Gum, then along his line South 20 N.W. 320 poles to his corner on McNEALS line North 50 N.W. to his corner Black Oak, then along another of his lines, South 40 NW, 160 poles to the Great Meadow, the corner of his patent, thence the same course 50 poles across the Meadow to the line of WILLIAM WHITEHEADS parcel, thence along it North 60 poles to his Black Oak corner, thence on the said ROGERS line North 20 East 75 poles to a Red Oak on his line North10 East 180 poles, to his corner 2 Black Oaks and a White Oak, then on his North 40 S.W. 170 to the first station, it being a portion granted to OSBORNE JEFFREYS, 150 acres bearing date the 16 th day of March 1743, to have and to hold the said parcel of land with all woods, under woods, ways, waters, water courses, gardens, orchards, commodities and advantages, with the appurtanances to him the said JAMES JOSSY, his heirs and assigns, to the only proper use and behoof of him the said JAMES JOSSY, his heirs and assigns forever and the said ELIAS WILLIS, for himself, his heirs, executors and administrators doth covenant, promise and agree to and with the said JAMES JOSSY, his heirs and assigns, that he the said ELIAS WILLIS, at the time of sealing and delivery of these presents hath in himself good right and lawful authority to give, grant, bargain and sell, the land unto him the said JAMES JOSSY, his heirs and assigns in manner and form aforesaid, that the said land now is, and shall forever hereafter remain, unto the said JAMES JOSSY, his heirs and assigns, free and clear, and freely and clearly acquitted and discharged of and from all former and sales, leases, mortgages, wills, entails and all other encumbrances whatsoever and lastly the said ELIAS WILLIS, for himself, his heirs and doth covenant, grant and agree to and with the said JAMES JOSSY, his heirs and assigns, that he the said ELIAS WILLIS, shall and will from time to time and at all times hereafter on the reasonable request of him the said JAMES JOSSY, his heirs and assigns at his or their proper cost and charges, make, do acknowledge and execute all and every other act and acts, deed and deeds, thing and things, appurtance and appurtances for the better and more perfect conveying the said parcel of land unto him the said JAMES JOSSY, his heirs and assigns forever, as by the council, learned in the Law, of him the said JAMES JOSSY, his heirs and assigns shall be devised or advised or required and witness whereof I have hereunto set my hand and seal the day and year above written.
