This indenture
made this 20th day of the 9th month 1848.
Between JAMES PEELLE, THOMAS PEELLE,& JOHN PEELLE, members of the
Society of Friends or properly called Quakers, all of Northampton County and
State of North Carolina on the one part.
MARTHA JOSEY & MARCUS W SMALLWOOD of the same
place of the other part.
Witnesseth that they the Society of Friends have a deed of conveyance
for a lot of land bearing date of 29th day of the 9th month 1759 and being in
the County and State aforesaid, and called Rich Square, on which their Meeting
House stands, and at which place they meet for divine worship, and adjoining
the land of MARTHA JOSEY, MARCUS W.
SMALLWOOD & JAMES RANDOLPH, a minor which they the said Society have
had & hold in full and quiet possession from the date of said deed. But the line or boundary of said lot of land,
not being kept up as they should have, and the Trees called for in the land is
now not to be found, and we of both parties being desirous to know the current
boundaries thereof have agreed to have the said lot of land surveyed, and a
current plat thereof made and attached to this agreement which is as follows. Viz. Beginning at a
Stone, when the old line called for a Hickory, in or near MARTHA JOSEY line at
the Road leading from Rich Square to Winton, thence along her line N 50 West 21
poles at the Road leading to Murfreesborough, when
the old deed called for a Red Oak, now a Stone, thence along said Road south 29
1/2 West 11 1/2 to a Stone, when the old called for a Post Oak & being
formerly RANDOLPH'S line, now SMALLWOOD, thence South 30 East 11 1/4 poles to a
Stone at the Wanton Road, thence said Road N 76 East 7 poles N 68 1/2 East 5
poles N 60 East 6 poles to the first station. And we of both parties can hold and firmly
bound to the strict adherence of this agreement. In witness whereof we have
hereunto set our hands and seals, the day and date first above written.
